John Kelchner has extensive experience in handling complex creditors’ rights and real estate finance matters by representing mortgage companies, banks and other financial institutions in defending their rights in state and federal court.
 
His background is rooted primarily in bankruptcy court where he advocates for large mortgage servicers as well as smaller lenders in consumer and business cases. In his bankruptcy practice, he assists his clients in asserting their claims and defending their interests in adversary proceedings.  In addition, John represents business creditors in state and federal court concerning mortgage foreclosure, collections, mechanics lien and repossession matters. He defends his clients in litigation involving lender liability matters such FDCPA, RESPA, and unfair trade practice/consumer credit claims. 
 
Furthermore, John regularly advises financial institutions and other creditors in complex real estate matters. These involve the resolution of title curative issues, tax sale disputes, and condemnation cases.  John has served as a panelist in various seminars, including those conducted by the South Carolina Bankruptcy Lawyers Association, regarding trends in bankruptcy, mortgage foreclosure and creditors’ rights.
 
John strives to obtain positive results by taking a detail-oriented, pragmatic approach to problem-solving. His relationships with members of the legal community, experience, determination and knowledge serve in efficiently achieving the best possible results for his clients. Acknowledging that the needs and objectives of his clients may vary greatly, John believes that creativity and flexibility are vital assets in meeting his clients’ expectations.
