Emily Jordan focuses her practice on business law, estate planning and probate. Her clients include large corporations, small businesses, startups and individuals. 

Emily advises clients involved in business and commercial litigation and commercial collections. Her experience includes corporate formation where she counsels startups on the various legal hurdles involved in successfully opening and operating a South Carolina business.

Additionally, she assists clients in matters involving estate planning and probate administration; probate litigation; trust administration; and guardianship and conservatorship issues. 

Working in conjunction with other professional advisors, Emily develops estate plans tailored specifically to clients’ needs taking into consideration a variety of factors including: family dynamics, the nature of assets, tax ramifications and generation skipping issues. Emily works with families, Trustees, Personal Representatives and beneficiaries to help them navigate the complicated and often difficult issues involved with probate and trust administration following a loved one’s death.

Knowing and understanding the details makes a difference. In each area of Emily’s practice, crafting successful outcomes is guided by a deep understanding the details unique to each client’s situation and ultimate objective. Emily understands the importance of seeing the whole picture while connecting the many parts of a situation to achieve a successful outcome. By understanding the client’s objectives, she can develop strategies that will help clients achieve their immediate and long-term goals. She prides herself on being responsive to clients and accessible, often making herself available after hours to ensure clients can rest easy when legal problems arise. 

Business/Business Litigation

  • Served as adviser to a multi-generational family business regarding a variety of issues ranging from corporate contracts to business entity formations to asset purchase agreements.
  • Counseled both startups and non-profits in corporate entity formation and governance.
  • Achieved favorable resolutions through mediation in litigation arising out of the breach of a corporate lease agreement.

Probate/Trust Administration

  • Represented the Estate in a probate administration involving business assets associated with a large-family farming operation, holding companies and various subsidiaries.
  • Successfully represented the Executor and successor Trustee in a unique case involving the probate of international assets and subsequent trust administration.

Estate Planning

  • Drafted estate plan where a beneficiary’s SSI benefits are protected through the use of a Special Needs Trust.
  • Counseled clients of blended families on how best to protect their assets through the use of various estate planning mechanisms.
  • Advised clients regarding Medicaid planning for long-term care.

Probate Litigation

  • Counseled the personal representative of an estate involving a petition for an Elective Share.
