Ian McVey has dedicated his practice to helping lenders, creditors, businesses and individuals sort through complicated situations. Ian focuses his practice on real estate and banking transactional matters, creditor’s rights, bankruptcy, banking litigation, real estate litigation, and contract disputes.

In his transactional matters, Ian represents lenders in the financing and restructuring of loans secured by real estate or other collateral.  He further represents his real estate clients in the acquisition, sale and development of properties throughout South Carolina. In addition to his transactional practice, Ian has long represented lenders, investors and other creditors in commercial and consumer foreclosures, claim and delivery actions, collections, bankruptcies under Chapters, 7, 9, 11, 12 and 13 of the United States Bankruptcy Code and contested lender liability matters. He also has years of experience in litigating real estate matters, contract disputes and other business litigation matters.

Ian has a long history of service to his profession and the community. He is a Past President of the Richland County Bar Association, served on its executive committee and was chair of its young lawyers division. Ian currently serves as Chair of the board of the Trinity Learning Center, a local faith based day care center in downtown Columbia.  

Ian’s father began practicing law in Richmond, Virginia in 1960. Hanging on the wall of Ian’s office is the original sign that hung in the lobby of his father’s office. He keeps that sign as a reminder that it is possible to balance hard work and dedication to your practice with a happy life.

Representative Matters

  • Successfully obtained relief from the Automatic Stay in a $397 million Chapter 11 bankruptcy matter in the face of opposition by the Trustee and Debtor.
  • Represented the lender in a $3 million development and construction loan for a large single family development.
  • Successfully litigated numerous contested foreclosure matters throughout the State of South Carolina including most recently representing an SBA backed lender in a matter involving lender liability issues.
  • In re: Ashley Oaks Development Corporation, 458 B.R. 280 (Bankr.S.C. 2011), successfully secured a dismissal of a Chapter 11 Bankruptcy Case over the objections of Debtor and a motion by the United States Trustee to convert the matter to a Chapter 7 case.
