David A. Luzumis a commercial litigator who represents individuals and businesses in high-stakes disputes involving real estate, contractual, business tort, fraud, unfair competition and trade practice, professional liability, and construction issues. His practice spans complex matters in state and federal court, including arbitrations, jury trials, and appeals, and he is known for his practical, business-minded approach from the earliest stages of a dispute through resolution.

David represents clients ranging from closely held companies to Fortune 500 organizations, helping them manage risk, protect key relationships, and pursue decisive outcomes when litigation becomes unavoidable. He leads Turner Padget’s Charlotte office, supporting the firm’s continued growth and client service efforts across North Carolina.

David brings significant experience in the construction industry, representing developers, general contractors, subcontractors, and suppliers in litigation arising from complex projects. He handles all manner of contract, scope-of-work, construction defect, and project delay disputes.

David also represents banks, credit unions, and national lenders in a variety of litigation matters.

A graduate of the Kenan-Flagler Business School at the University of North Carolina at Chapel Hill, David earned his J.D. from the University of North Carolina School of Law, where he served on the North Carolina Law Review.

Outside the office, David enjoys watching soccer, playing golf, and cheering on the Tar Heels and Georgia Bulldogs. He and his wife, Sarah Beth, have three children.

  • Represented a national real estate broker in a multi-million-dollar contract dispute with a property owner and lessee.
  • Successfully defended a business owner at trial against breach of contract claims by a landlord and against fraud-based claims by a third party arising out of a franchise relationship.
  • Represented a nationwide construction building material supplier in a multi-million-dollar contract dispute with the purchaser over material pricing and escalations.
  • Represented building owners in construction defect claims related to water intrusion against a general contractor.
  • Represented condominium association in a negligence action against an insurance broker following fire damage to a building.
  • Represented a UK-based construction project safety equipment manufacturer in a contract dispute with its North American sales representative.
  • Represented a national title insurance company in an accounting malpractice action against an auditor arising out of a $25+ million fraud scheme.
  • Represented a commercial property owner in an action against its insurer to recover for hail damage to more than 10 properties.
  • Represented the buyer in an action to compel the sale of a commercial property pursuant to a purchase agreement.
  • Represented a local business in the enforcement of numerous non-competition agreements against former employees.
  • Managed high-volume dockets of collection and defense actions for various financial institutions.
  • Successfully obtained dismissal of multi-million-dollar claim against the County for alleged violations of the Contracts Clauses of the U.S. and Georgia Constitutions. Avery v. Paulding County Airport Auth., 343 Ga. App. 832, 808 S.E.2d 15 (2017)
  • Successfully defended a shareholder at trial against claims of fraudulent conveyances asserted by the bankruptcy trustee. Howell v. Fulford (In re Southern Home & Ranch Supply, Inc.), 561 B.R. 810 (Bankr. N.D. Ga. 2016).
  • Won summary judgment in favor of a general contractor accused by a subcontractor of embezzling and converting funds. Sand-Stone, Inc. v. Camp (In re Camp), 514 B.R. 917 (Bankr. N.D. Ga. 2014).
