Hannah Stetson, a Columbia-based shareholder on our employment team, recently authored an article for Columbia Business Monthly examining changes that impact businesses across South Carolina.

The United States Department of Labor (DOL) Final Rule regarding minimum wage and overtime pay requirements for executive, administrative, and professional employees under the Fair Labor Standards Act (FLSA) went into effect on July 1, 2024. This rule, expected to impact upward of 4 million workers across the United States, significantly increases the salary threshold for minimum wage and overtime exemption requirement. A further increase to the salary threshold is expected in January 2025 under the Rule. 

The Rule is not without criticism, however, and legal challenges could hinder its further impact. We are diligently monitoring any legal challenges and any other developments that may impact South Carolina employers, and we will provide updates as they unfold.

While the lawsuit works its way through the court system, it’s important for employers to review their compensation policies and job descriptions to ensure compliance.
